1. RENTAL AGREEMENT
1.1- Upon arrival to my hotel, villa or home; it is my responsibility to call Innabi Rentals if rented equipment is not at the proper location. Innabi Rentals will make sure that all equipment is delivered by 6:00 pm of the reservation date.
1.2- All rented items will be returned in their respective bags to the original pick-up location; by 10:00 am; on the day of departure.
1.3- It is my responsibility to take proper care of items rented and to return them in good clean condition.
1.4- I am responsible for any lost items.
1.5- Upon arrival; on my first day; I will call Innabi Rentals and let them know of any damaged equipment. Innabi Rentals will replace the damaged item; the same day, at no extra cost. If I don’t report any damage on the first day; it means I am accepting the equipment to be in good working and “as is” condition and I will be responsible for any damaged equipment when returned to Innabi Rentals .
1.6- Any extra cleaning or damage to rented equipment will be charged to my credit card up to the fair value of the damaged item.
1.7- If I cancel this reservation within the 24 hours prior to my arrival date; I will not be eligible for a refund and I will accept the charge. I need to cancel at least 24 hours in advance to get a refund. This refund will be in full.
1.8- If I want to extend my rental time, I will notify Innabi Rentals 24 hours prior to return date and obtain a confirmation number. Failure to do so will result in a service fee of $25.00 plus regular charges for the extra rented time.
1.9- Cribs are to be assembled and disassembled by Innabi Rentals staff only. Cribs must not be moved from room to room; except by Innabi Rentals staff.
2. WAIVER AND ASSUMPTION OF RISK
2.1- I do voluntarily agree to this waiver and assumption of risk in favor of Innabi Rentals in consideration for any or all of the following:
A. The opportunity to use the equipment rented to me through this website, and/or
B. The opportunity to receive instructions in an activity resulting from the rental of equipment through this website.
2.2- I fully understand that there are certain risks and dangers associated with the use of equipment and/or activities that cannot be eliminated regardless of the care taken to avoid injuries; and that I am aware of these risks and dangers.
2.3- I fully assume the risks and dangers involved as acceptable to me and I agree to use my best judgment in undertaking these activities and to follow all safety instructions.
2.4- I waive, release, covenant not to sue, and agree to indemnify and hold harmless Innabi Rentals , its owners, and employees from any claims, actions, suits, costs, expenses, damages or liabilities, including attorney’s fees for personal injury, property damage, accidents, illnesses, death, or any incidental damages that may arise from my use of the equipment rented by me.
2.5- By using this website I state that I am a competent adult over the age of 18 and assume these risks of my own free will.
2.6- I have read this Waiver of Assumption of Risk and I fully understand its terms. I understand that I am giving up substantial rights, and I acknowledge this to be a complete and unconditional release of all liability to the greatest extent allowed by law.
3. OTHER TERMS & CONDITIONS
3.1- Innabi Rentals currently provides users with the ability to book rental of equipment on-line, among other services (collectively, the “Service”). Unless explicitly stated otherwise, any new features that augment or enhance the current Service, including the release of new Innabi Rentals features, shall be subject to these Terms & Conditions of Service.
3.2- Innabi Rentals reserves the right to contact you via phone, e-mail, or post mail regarding current and/or future orders placed with Innabi Rentals . Any customer may opt out of receiving future contact from Innabi Rentals at any time, by unsubscribing from our email correspondence.
3.3- Innabi Rentals reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice to you. You agree that Innabi Rentals , in its sole discretion, may terminate your account (or any part thereof) or your use of the Service, and remove and discard any Content for any reason, including, without limitation, for lack of use or if Innabi Rentals believes that you have violated or acted inconsistently with the letter or spirit of the Terms & Conditions of Service. Innabi Rentals may also in its sole discretion, and at any time, discontinue providing the Service, or any part thereof, with or without notice to you. You agree that Innabi Rentals shall not be liable to you for any loss or damage you may suffer due to any modification, suspension, termination or discontinuance of the Service.
3.4- Except as expressly set forth herein:
A. Your use of the Service is at your sole risk. The Service is provided on an “as is” and “as available” basis. Innabi Rentals expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement.
B. Innabi Rentals makes no warranty that:
(i) the Service will meet your requirements,
(ii) the Service will be uninterrupted, timely, secure, or error-free,
(iii) the results that may be obtained from the use of the Service will be accurate or reliable, and
(iv) the quality of any products, services, information, or other material purchased or obtained by you through the Service will meet your expectations.
C. No advice or information, whether oral or written, obtained by you from Innabi Rentals or through the use of the Service shall create any warranty not expressly stated in these Terms & Conditions of Service.
3.5- The Terms & Conditions of Service constitute the entire agreement between you and Innabi Rentals and govern your use of the Service, superseding any prior agreements between you and Innabi Rentals . These Terms & Conditions of Service and the relationship between you and Innabi Rentals shall be governed by the laws of the State of Florida, without regard to its conflict of law provisions. For the purpose of resolving any dispute, the state and federal courts located in Osceola County, Florida shall have exclusive jurisdiction. The failure of Innabi Rentals to exercise or enforce any right or provision of these Terms & Conditions of Service shall not constitute a waiver of such right or provision. If any provision of these Terms & Conditions of Service is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the other provisions of these Terms & Conditions of Service remain in full force and effect. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Service or these Terms & Conditions of Service must be filed within one (1) year after such claim or cause of action arose or be forever barred.
3.6- MODIFICATIONS TO THE WEBSITE, PRODUCTS, OR SERVICES: We reserve the sole right, for any reason, with or without notice to (i) terminate, change, suspend, or discontinue any aspect of our website, product, or service or in its entirety including features and hours of operation and availability, and (ii) impose limits on certain or all features of our website, products, and services, or restrict your access to a part or all of our website, products, and services. All or part of our website, products, or services can be subject to change with or without prior notice and solely at our discretion based on emerging technologies, business practices, and customer needs.
3.7- REFUSAL OF SERVICE: We hold the sole right to be the arbiter of what is and what is not a violation of our Privacy Policy and Terms & Conditions of Service. We reserve the right to refuse service to, or terminate the order of any user, for any reason, at our sole discretion. We may refuse or terminate orders if we believe that the conduct of any user violates any applicable law. If any of our users engage in any behavior that we feel is detrimental to our services, then we reserve the right to terminate that user’s order immediately.
